Terms of Service

These terms govern your use of the Ripped! Restock iOS app (the "App"), published by Bo Jackson Battle Arena, Inc. (dba BoBattle) ("BoBattle," "we," "us").

1. Acceptance

By downloading, installing, or using the App, you agree to these Terms. These Terms apply in addition to Apple's Standard End User License Agreement, which is incorporated by reference and available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If there is a conflict for App Store–specific matters, Apple's EULA controls for those matters; otherwise, these Terms control.

2. Eligibility

You must be at least 12 years old to use the App. If you are using the App on behalf of a partner retail shop, you represent that you are authorized to do so.

3. Accounts

• You must provide accurate information when creating your account.
• You are responsible for keeping your credentials confidential and for activity on your account.
• One account per person. Sharing accounts is not permitted.

4. Acceptable use

You must only submit content that depicts genuine restock activity at an authorized partner shop, and for which you own the rights or have permission to record (including permission from anyone identifiable in the footage). You will not:

• submit illegal, harassing, or infringing content;
• impersonate another person or shop;
• attempt to bypass moderation, scrape the API, or interfere with other users' submissions;
• use the App for any purpose other than the restock workflow it is built for.

5. Your submissions

You retain ownership of the photos, videos, and audio you submit. You grant BoBattle a worldwide, non-exclusive, royalty-free license to store, process, display, and review your submissions for the purpose of operating and improving the service, including showing them to the relevant shop owner and our internal review staff. We will not publish your submissions publicly and will not sublicense them to any third party outside the processors described in our Privacy Policy.

6. Moderation and removal

Every submission is reviewed by BoBattle staff. We may approve, deny, request changes to, or remove any submission at our discretion. You do not have a right to have any particular submission approved, retained, or displayed.

7. Account deletion

You can request account deletion from within the App. Requests are reviewed by an admin. You may cancel a pending request at any time before it is approved. Once approved, your account and associated personal data are permanently deleted, subject to the retention exceptions described in our Privacy Policy.

8. Intellectual property

BoBattle owns all rights in the App itself, the Ripped! Restock and BoBattle brands, and the user interface. Your submissions remain yours, subject to the license in §5.

9. Termination

Either of us may terminate your access at any time. You can terminate by requesting account deletion (see §7). We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. For legal and audit purposes we may retain submissions for up to 90 days after termination before deletion.

10. Disclaimers

The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee uninterrupted availability or that the App will be error-free.

11. Limitation of liability

To the maximum extent permitted by law, BoBattle and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the App is limited to the greater of (a) the amounts you paid us for the App in the 12 months preceding the claim (the App is free, so this is typically $0) and (b) US $100.

12. Indemnification

You agree to indemnify and hold BoBattle harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your submissions, (b) your violation of these Terms, or (c) your violation of any third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws principles. Before filing any formal claim, you agree to first contact us at help@ripped-restock.com and attempt informal resolution for at least 30 days. Any claim that cannot be resolved informally will be brought in the state or federal courts located in Richland County, South Carolina, or, at your election, in small-claims court where jurisdiction permits.

14. Changes

We'll update the "Last updated" date above when we make changes. If the change is material, we'll also notify you in-app.
